Introduction
TicVision ("we," "us," or "our") is a mobile application and clinician web portal designed to help track Tourette’s syndrome symptoms through manual user logging. We are committed to protecting your privacy and keeping your personal information secure. This Privacy Policy explains what information we collect from users, including health information that may be considered Protected Health Information ("PHI") under the U.S. Health Insurance Portability and Accountability Act of 1996 (HIPAA), how we use and safeguard that information, and your rights regarding your data. We follow applicable laws and regulations, including HIPAA, to ensure the confidentiality and security of your health data. By creating an account or using TicVision, you consent to the practices described in this Privacy Policy.
Information We Collect
- Personal Identifiers: When you create an account, we collect personal information such as your name, email address, and a password. We may also collect your date of birth or age to determine eligibility (for example, if parental consent is required for minors). Account creation is required to use the platform, ensuring that only authorized users can access their data.
- Health and Symptom Data: TicVision allows you to manually log information related to Tourette’s symptoms, which may include details about tics (frequency, intensity, type), mood, triggers, medications, or other health-related notes. All data you enter into the app about your symptoms or health is stored and associated with your account. This health data is considered sensitive and is protected under HIPAA as PHI when linked with your personal identifiers.
- Clinician-Provided Information: If you are using TicVision in conjunction with a healthcare provider (such as your doctor or clinician), that provider may input or view certain information about you through the clinician portal. For example, a clinician might add notes or review your logged data. We may collect the clinician’s name and contact information and link them to the patient users who have consented to connect with that clinician. Clinicians will only have access to data for patients with whom they have a treatment relationship and proper authorization.
- Automatically Collected Data: TicVision may collect certain technical information automatically when you use the app or portal. This can include device information (e.g., device type, operating system, app version), log data (such as IP address, timestamps of access, and usage logs), and cookies or similar technologies on the web portal to manage sessions. We collect this information to maintain the security of the service, fix bugs, and improve user experience. This technical data is generally not used to identify you, except in cases necessary to ensure system integrity or investigate misuse.
- Children’s Data: TicVision is available for use by minors under 18, with appropriate consent (see Children’s Privacy below). When a minor uses the service, we may collect the same types of information (personal identifiers and health data) for that minor. Additional safeguards and consent requirements apply, as detailed in the Children’s Privacy section of this Policy.
How We Use Your Information
We use the information we collect for the following purposes:
- Providing and Improving the Service: We process your personal and health data to operate TicVision’s core functionality. This includes allowing you to log your Tourette’s symptoms, saving those entries, displaying your historical data to you, and enabling features like charts or reports. If you are connected with a clinician, we use your data to present it to that clinician through the secure portal, so they can monitor your symptoms and provide care. Your clinician may use this information to track your progress and adjust treatment, as well as to generate reports or documentation needed for your healthcare (for instance, to support billing for Remote Therapeutic Monitoring (RTM) services).
- Account Management and Communication: We use your email and other personal identifiers to create and manage your account, authenticate you when you log in, and communicate with you about your use of the service. For example, we may send you service-related emails such as account verification, password reset links, updates about new features, or notices of changes to this Privacy Policy or Terms and Conditions. We will not send you marketing emails unrelated to TicVision’s service without your explicit consent.
- Healthcare Operations: As a platform handling health information, we may use your data for operational purposes in support of healthcare activities. This can include quality assessment and improvement activities, customer support, and development of clinical insights. For example, a clinician might download a report of your logged data to include in your medical record or to facilitate remote therapy oversight. We allow such downloads for the clinician’s use, and it is the clinician’s responsibility to handle that downloaded information in compliance with privacy laws and their own policies.
- Analytics and Product Improvement: We may use de-identified and aggregated information to understand how users interact with TicVision and to improve our products. For instance, we might analyze which features are most used or evaluate overall trends in symptom logging (without identifying any specific user) to guide future app enhancements. This may involve looking at statistical trends like “X% of users log moods daily” or similar metrics that do not identify individuals. Any analytics are performed in a manner consistent with user confidentiality.
- Research and Development (De-Identified Data): In the future, we may use information you provide in a de-identified form to train machine learning models or for other research and development purposes. "De-identified" means that all personal identifiers (such as your name, email, or any other direct identifiers) have been removed or anonymized so that the data cannot reasonably be used to identify you. For example, we might use a large collection of symptom logs and outcomes, stripped of names and contact info, to improve our understanding of Tourette’s patterns or to develop new features like predictive analytics. Any such use of data will be done in compliance with HIPAA’s de-identification standards and other applicable laws. De-identified data does not constitute PHI and may be used by TicVision for purposes such as improving the service, research, or algorithm development without further notice to you, as permitted by law. However, we will not use or share any information that could still identify you for these purposes without your consent.
- Safety, Security, and Legal Compliance: We may use your information to maintain the security of our platform and users. This includes using data to detect, investigate, and prevent fraud or abuse of TicVision. If necessary, we will use and disclose information to comply with applicable laws and regulations, court orders, or lawful requests by government authorities. For example, if we are required by law to report certain information or respond to a subpoena or a legal process, we will only do so to the extent such disclosure is permitted or required under applicable law (including HIPAA and other privacy laws). If we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, or investigate fraud, we may use or disclose relevant information as allowed by law.
We will not use your personal or health information for any purposes other than those described above without obtaining your permission. In particular, we do not use your health data for advertising purposes, and we do not sell or rent your personal information to third parties.
How We Share and Disclose Your Information
We understand that your health information is sensitive. TicVision only shares your data in a few limited situations, as described below:
